Privacy Policy – Transparency, Consent & Creative Integrity

Your trust matters. This page outlines how your data, communications, and photos are handled—with respect, clarity, and creative boundaries.

Introduction

At Skai Chan Photography, your privacy and trust are central to our work. This policy outlines how we handle your information and photos with transparency and fairness.

Privacy Policy

Collection of Browsing Information

We may collect browsing information through third-party services, such as Google Analytics, to track website traffic, gain insights and protect against spam. This data is crucial for enhancing our services and ensuring a smooth user experience.

Communication Records

All communications between you and Skai Chan Photography will be securely stored as a reference. This helps us improve our photography sessions and assists in resolving any disputes that may arise.

Information and Photo Viewing

Skai Chan Photography team or advisors may review information provided by clients and photos taken during our photography sessions. This ensures that we can make the best decisions to create high-quality photos that meet your expectations.

Consent for Photo Sharing

By default, selected images may be showcased in our portfolio, website, marketing work, or competitions. This is standard practice in professional photography and helps us demonstrate our work. If you prefer full confidentiality, you may opt for our Privacy Guarantee (Buyout), which ensures your photos remain private. This option is available at an additional fee, as indicated in our packages.

Photo Retention

Final photos are stored in a private folder temporarily for clients to download. Once clients have acknowledged download, or after a short retention period, the folder and files will be deleted from the server. This ensures privacy, protects client data, and allows us to manage server space responsibly. Requests for re-uploading may incur a fee and are subject to availability, as files may no longer be retrievable.

Photo Writeups

Skai Chan Photography may create writeups when posting photos on our website or social media. If you have concerns about your name being mentioned, please raise this during the initial consultation.

Creative Freedom

Every writeup is considered the creative work of Skai Chan Photography and we retain all rights to write about various aspects of the shoot, including the challenges encountered. No one has the authority to demand changes to the contents.

Changes and Fees

Requests to amend or remove published content require significant effort and may incur additional fees. These fees cover the time invested in publishing, restructuring, and the professional impact of portfolio loss. Outstanding payments for the original shoot will also be included. This ensures fairness and transparency for both parties.

Copyright & Usage Rights

Under Singapore law, photographers retain copyright to the images they create by default, unless explicitly transferred by contract. Clients receive usage rights for personal or agreed purposes. The Privacy Guarantee (Buyout) does not transfer copyright but ensures images remain unpublished and confidential.

FAQ

General Privacy Questions

How do you handle my personal information?
I collect your personal information only to communicate with you, book your session, and deliver your photos. I do not sell or share it for marketing purposes. Information may be reviewed by trusted team members or advisors to improve service quality or for legal reasons.
Do you sell or share my information with third parties?
No. Your information is never sold or shared for marketing. It may only be reviewed internally to enhance service quality or protect against misuse.
What browsing data do you collect when I visit your website?
I use third-party services such as Google Analytics to track website traffic. This helps improve services and protect against spam.
Are my emails, messages, or calls with you kept private?
Yes. All communication is kept private and securely stored. Records are maintained to improve services and resolve any potential disputes.
Can I ask you to delete my personal data?
Yes. However, some records may need to be retained for legal or business reasons.

Copyright & Usage Rights

Who owns the copyright to my photos?
By default, under Singapore law, the photographer retains copyright to all images created unless explicitly transferred by contract. Clients receive usage rights for personal or agreed purposes. If you prefer full confidentiality, you may opt for the Privacy Guarantee (Buyout). Learn more from IPOS.
Can I use my photos for commercial purposes?
Commercial use requires a separate licensing agreement.
Can I request that my photos not be posted anywhere?
Yes. This must be arranged before the shoot by selecting the Privacy Guarantee option, which ensures your photos remain private and unpublished. This option is priced separately to reflect the value of portfolio rights.
What if I initially agreed to let you post my photos but change my mind later?
If you withdraw consent after your photos have been published, additional costs will apply. These cover the time and effort spent on publishing, restructuring, and the professional impact of portfolio loss.
Why don't I see copyright and privacy buyout options on other photographers' websites?
Not all photographers make the effort to explain these details upfront. Many simply include portfolio use by default without mentioning it explicitly. I choose to state copyright ownership and the Privacy Guarantee (Buyout) clearly so clients understand their options from the beginning. This transparency helps avoid misunderstandings and ensures fairness for both parties.

Privacy & Social Media

If I do a shoot that reveals a lot of skin (e.g., bodyscape, art, boudoir) and I don't choose privacy, how will you handle the photos?
To respect all clients, I apply self-censorship. For photos that are overly revealing, I may use Photoshop to add mosaics or other forms of censorship before posting.
Where will my photos be posted?
Unless you've selected the Privacy Guarantee option, your photos may be used on my website, social media, marketing materials, competitions, or educational purposes.
Can I ask you not to mention my name when you post my photos?
Yes. Please let me know at the start of our consultation. If you request anonymity only after your photos have already been posted, an Amendment Fee will apply. This fee covers the time and effort required to update captions, write-ups, metadata, social media posts, and to rename and relink URLs where necessary.
Do you write about photoshoots when posting images?
Yes. I often share creative insights and experiences from the shoot. These write-ups are part of my artistic expression and cannot be altered, though you may request anonymity at the start of the project.
Can I request to remove a social media post featuring my photos?
Yes, but this will incur a fee to cover the time and effort spent creating, uploading, and removing the content.

Client Requests & Agreements

Can I bring my own privacy agreement?
I work based on my standard terms but am open to discussing reasonable requests before the shoot.
Can I request that nobody sees my photos, including your team?
No. Trusted team members or advisors may need to review the photos for editing and quality control.
Do you offer NDAs (Non-Disclosure Agreements)?
Yes, NDAs are available at an additional fee.
What if I don't want my photos used for marketing but don't want to pay for privacy?
Portfolio use is standard practice in professional photography, as it allows photographers to showcase their work and sustain their business. If you prefer not to have your photos used for marketing but do not wish to select the Privacy Guarantee option, I may not be the right fit for your needs. In that case, I encourage you to consider working with another photographer whose terms better align with your preferences.

Legal & Fees

What happens if my photos are accidentally posted after I requested privacy?
I take privacy seriously. If a mistake happens, I will remove the images immediately and take corrective action.
Can I get into legal trouble if I use the photos without permission?
Yes. Using copyrighted photos without permission may result in legal action.

Editing & Retouching

Who edits my photos?
I personally edit all photos. In the future, trusted professionals may assist under strict confidentiality.
Will my unedited photos be shared with anyone?
No. I do not release unedited photos to maintain professional standards, except in limited educational contexts.
Can I request that certain people not see my photos during editing?
We can discuss this before the shoot, but I cannot guarantee that no trusted team members will review the photos.
Can I request edits for privacy reasons?
Yes. Edits such as blurring or censoring can be requested, but additional fees may apply.
What if I find an issue with my photos after they've been posted?
If there is a genuine mistake, I will review it. Requests for changes may incur additional fees.
