Service Agreement

Introduction

This Service Agreement sets out the general terms under which Skai Chan Photography provides photography services. It is intended to help the Clients and the Photographer understand their respective responsibilities, expectations, limitations, and working arrangements before a photography session begins.

This agreement applies to photography services including, but not limited to, portraits, events, weddings, corporate photography, real estate, interiors, lifestyle photography, and other commissioned photography work. Where a quotation, package, written agreement, or other booking-specific arrangement contains terms that differ from this general agreement, the booking-specific terms will apply to the extent agreed in writing.

This agreement may be updated from time to time. The version applicable to a confirmed booking will be the version agreed to by the Clients at the time of confirmation, unless a subsequent change is expressly agreed by both parties.

Entire Agreement

This agreement, together with the applicable quotation, package details, written booking arrangements, and other terms expressly agreed between the Clients and the Photographer, forms the understanding between the Clients and the Photographer regarding the photography service.

Mutual Trust

By engaging the Photographer, the Clients acknowledge that photography involves professional judgement, creative decisions, technical considerations, and circumstances that may not always be completely predictable. The Clients agree to communicate honestly and cooperate reasonably with the Photographer, while the Photographer will use his professional judgement and best reasonable efforts to provide the agreed service.

Booking & Scheduling

Pre-booking Consultation

The Clients should provide accurate and sufficient information about the requested photography service before confirming a booking. This may include the type of photography, location, date, duration, number of subjects or guests, intended use of the photographs, special requirements, privacy requirements, delivery requirements, and other information that may affect the quotation or preparation.

Under-declaration of Requirements

The Photographer reserves the right to revise a quotation, decline additional requirements, or make other reasonable adjustments where important information was not disclosed before the booking was confirmed.

This may include significant changes to the location, duration, number of people, nature of the event, photography requirements, express delivery, privacy requirements, commercial usage, special editing, or other requirements that materially affect the work involved.

If an additional requirement cannot reasonably be accommodated, the original agreed photography service may proceed without that additional requirement.

Booking Confirmation

A required booking fee must be paid to secure the photography service and reserve the Photographer's time. The booking is not considered confirmed until the required booking fee has been received and the booking has been accepted by the Photographer.

Quotation, availability, package details, and other arrangements may change before the booking is confirmed.

Bookings Without a Confirmed Date

If a booking is confirmed without a specific photography date being selected, the booking will remain valid for three (3) months from the date the booking is made, unless otherwise agreed in writing.

If the Clients select a date after making the booking fee payment, the three-month period does not restart. The original booking date remains the date from which the three-month period is calculated.

Postponement of a Confirmed Date

If a specific photography date has already been confirmed, the Clients should make any request to postpone or reschedule the photography session as early as reasonably possible.

A postponed session may, at the Photographer's discretion, be completed within three (3) months of the originally booked date. This is not an automatic entitlement. Any postponement remains subject to the Photographer's availability, the circumstances of the request, and the practical requirements of the photography service.

The three-month period is calculated from the originally booked photography date and does not restart when the Clients request or select a new date.

Requests to postpone a booking for reasons unrelated to circumstances reasonably affecting the photography session may be declined where the postponement would unfairly affect the Photographer's ability to accept other work.

Cancellation

If the Clients cancel a confirmed booking, the required booking fee is non-refundable, subject to applicable law. The booking fee compensates the Photographer for reserving the date and time and potentially declining other work for that period.

Additional Photography Time

Clients are advised to book sufficient time for the photography session. Photography may involve preparation, briefing, travelling between nearby locations, setting up equipment, communication with subjects, lighting adjustments, breaks, and other activities that form part of the booked attendance.

Additional photography time is subject to the Photographer's availability. Where additional time is requested or becomes necessary, the applicable charges will be based on the relevant package and will normally be charged in the applicable time blocks.

For example, where a package is charged at $100 per 30-minute block, exceeding the booked duration by even a small amount may result in the next 30-minute block being chargeable at $100. The Photographer uses block-based charging rather than charging by the individual minute so that additional time can be handled clearly and consistently.

Where reasonably possible, the Photographer will advise the Clients of applicable additional charges before continuing beyond the booked duration.

Payment

The required booking fee, payment schedule, payment methods, and other payment-related arrangements are explained on the Payment page and in the applicable quotation or booking arrangement.

The Clients are responsible for making payments according to the agreed payment schedule. Full payment must be received before final photographs are delivered unless otherwise agreed in writing.

Payment terms may vary according to the photography service or package. Where a booking-specific quotation states different payment arrangements, the quotation will apply.

General Working Arrangements

Booked Duration

The booked duration refers to the period reserved for the photography service. The Clients should understand that photography is not limited to the act of pressing the shutter. Briefing, communication, preparation, equipment setup and dismantling, lighting adjustments, movement between locations, reasonable breaks, and other necessary activities may take place within the booked duration.

Briefing & Communication

The Photographer may require time before or during the photography session to explain the intended approach, discuss the sequence of activities, provide creative direction, understand the Clients' requirements, or make adjustments based on the circumstances of the shoot.

The Clients should also communicate important requirements, concerns, restrictions, and preferences clearly. Time spent on necessary briefing and communication forms part of the booked photography time.

Breaks

For longer or physically demanding photography sessions, reasonable breaks for meals, hydration, rest, or other necessary personal needs may be required. The Photographer and Clients may also request a reasonable break where circumstances make one appropriate.

Breaks taken during the booked photography period form part of the booked duration unless otherwise agreed in writing.

Punctuality & Schedule

The Clients are expected to arrive and be ready at the agreed starting time. The booked starting time remains the scheduled start of the photography service even if the Clients arrive late.

Late arrival by the Clients may reduce the available photography time. The Photographer cannot guarantee that time lost through lateness can be recovered without extending the booking and applying the applicable additional-time charges.

If the Photographer is late for reasons within his responsibility, he will make reasonable efforts to make up the lost photography time where practical.

Location & Access

The Clients are responsible for ensuring that agreed photography locations are accessible and that any necessary permissions, reservations, permits, access arrangements, venue approvals, or other requirements have been obtained before the photography session.

Where a venue, location, attraction, building, parking facility, or other site requires an entrance fee, photography fee, booking fee, permit fee, parking fee, or similar charge for the Photographer to carry out the agreed service, such costs will be paid by the Clients unless otherwise agreed in writing.

Travel Between Locations

Where the photography session involves multiple locations, the Clients should allow sufficient time for travelling and moving equipment between locations. The Photographer should not be expected to rush while carrying or transporting photography equipment in order to recover time lost through an overly ambitious schedule.

Clients who wish to cover multiple locations should consider booking a longer duration or be prepared for additional photography time where necessary.

Cooperation

The Clients and Photographer agree to communicate and cooperate reasonably throughout the photography session. The Photographer may provide suggestions or directions intended to improve the photographs, while the Clients remain responsible for communicating relevant preferences and requirements.

Pace of Photography

The Photographer works at a deliberate pace intended to prioritise quality, composition, lighting, communication, and natural-looking results rather than simply maximising the number of photographs taken.

The Clients should not rush the Photographer through the photography process, including during movement between locations, lighting adjustments, posing, composition, equipment setup, or other necessary activities. Where the planned schedule is too tight to allow the Photographer to work properly, the Clients should consider booking additional time.

Quality over Quantity

The Clients acknowledge that the quality and suitability of the photographs are more important than simply producing a large number of images. The Photographer will use professional judgement to determine when a scene, composition, lighting arrangement, or moment has been adequately captured.

Portraits, Subjects & Direction

Posing & Direction

For portrait and people-focused photography, the Photographer may provide verbal direction, demonstrations, positioning suggestions, and other forms of creative guidance to help subjects feel comfortable and produce natural-looking photographs.

Physical contact is not required as part of the Photographer's standard working method. The Photographer generally uses verbal communication and demonstrations instead. This approach helps maintain clear personal boundaries and respect between the Photographer and subjects, although it may sometimes require additional time for subjects to understand or reproduce a suggested pose.

Hair & Makeup

Clients and subjects are responsible for their own hair, makeup, grooming, and wardrobe unless these services have been specifically included in the selected package.

For portrait sessions, events, and other photography involving significant attention to appearance, Clients are encouraged to engage a professional hair and makeup artist where appropriate. The Photographer can recommend professionals with whom he has worked previously through the makeup and hairstyling recommendations.

Subject Cooperation

The quality and variety of photographs may depend on the cooperation, communication, energy, movement, and availability of the subjects. The Photographer cannot guarantee a particular result where subjects are unwilling or unable to cooperate.

Events & Guests

Event Coverage

For events, the Photographer will use professional judgement to document the important people, moments, details, atmosphere, and activities that can reasonably be covered within the booked duration.

The Clients should provide sufficient information about important activities, people, timings, and programme elements so that the Photographer has a reasonable opportunity to prepare and position himself accordingly.

Guests & Interference

Guests may use their own cameras or mobile phones during an event. Guests may also approach the Photographer to ask questions, discuss photography, request photographs, or otherwise interact with him.

The Photographer will use his professional judgement to remain courteous while managing such interactions and returning his attention to the agreed photography service.

The Photographer cannot be responsible for missed or compromised photographs where guests or other persons repeatedly obstruct, interrupt, redirect, distract, or otherwise interfere with the photography process.

Clients' Responsibility for Guests & Additional Subjects

The Clients are responsible for ensuring that family members, friends, colleagues, guests, models, or other subjects participating in the photography session understand that the Photographer's services are governed by the agreed package and Service Agreement.

Other persons present at a shoot may not be familiar with the Photographer's pricing, editing standards, photography style, privacy arrangements, copyright terms, or other requirements. Statements such as "just Photoshop it" or requests for extensive editing should therefore not be treated as automatically included in the photography service.

Requests for substantial retouching, background replacement, object removal, reconstruction, manipulation, or other advanced or extreme editing may incur significant additional fees and may not always be technically or aesthetically feasible.

The Photographer maintains his own professional editing standards and may determine that certain photographs cannot reasonably be altered to produce a natural-looking result. Additional payment does not guarantee that every photograph can be successfully edited or transformed.

Key Moments & Assistance

For events, the Clients should provide sufficient notice of important moments such as speeches, cake cutting, award presentations, bouquet throwing, performances, entrances, or other planned activities.

Where appropriate, the Clients are encouraged to appoint a helper who can identify important people, assist with organising group photographs, and help the Photographer communicate efficiently during the event.

Guest Photography

Guests may naturally wish to photograph the Clients or subjects themselves. The Clients agree to give the Photographer reasonable opportunity and precedence to carry out the agreed photography service.

The Photographer cannot be responsible for missed photographs where guests repeatedly stand in front of the Photographer, use flashes that interfere with the Photographer's lighting, redirect subjects, or otherwise prevent the Photographer from carrying out the agreed coverage.

Weather & Unforeseen Circumstances

Wet Weather

Outdoor photography in Singapore is subject to changing weather conditions. Weather forecasts are not guarantees, and rain may occur only in certain areas or for relatively short periods.

For this reason, an outdoor booking will generally proceed at the agreed date and time even when rain is forecast. Clients should prepare an appropriate sheltered or indoor alternative location in advance, preferably near the intended outdoor location.

If rain or other wet-weather conditions make an outdoor location unsuitable or unsafe, the photography session may proceed at an agreed sheltered location instead. The Clients are responsible for ensuring that the alternative location is reasonably suitable and accessible.

The Photographer will not be expected to continue using photography equipment in conditions that may reasonably risk damage to the equipment or create an unsafe working environment. The Photographer's decision regarding equipment safety will be final.

Clients who are particularly concerned about wet weather should take Singapore's unpredictable weather into account when selecting the date and location and should prepare a suitable sheltered alternative. Clients may also choose a period with a generally lower likelihood of rainfall, while understanding that no period guarantees dry weather.

Other Unforeseen Circumstances

Where circumstances outside the reasonable control of either party materially affect the photography service, the Clients and Photographer will communicate and consider reasonable practical alternatives where possible.

The Photographer is not required to accept a postponement where the circumstances do not reasonably justify postponement or where doing so would unfairly prevent him from accepting other work.

Lighting & Photography Conditions

Flash & High-End Photography

For packages incorporating professional flash photography, the Photographer may set up portable strobes, light modifiers, stands, and other lighting equipment. This process requires preparation, testing, adjustment, and dismantling time.

Changes in location, available space, sunlight, ambient lighting, subject position, or venue restrictions may require additional lighting adjustments and testing. The Clients agree to allow reasonable time for these technical processes.

Where external factors such as venue restrictions, weather, safety considerations, time limitations, or other circumstances prevent the intended use of flash photography, the Photographer may adapt the lighting approach and use available light photography where reasonably possible.

Available Light Photography

The term "natural light photography" may be used in photography packages for ease of understanding. Technically, the Photographer may use available light from both natural and existing artificial sources, including sunlight, lamps, and ceiling lights.

Where available light is unsuitable or insufficient, the Photographer may enhance the lighting using additional equipment, such as an on-camera speedlite, where practical.

Venue & House Rules

The Photographer may be subject to rules imposed by venues, registrars, ministers, building management, event organisers, or other authorities. These rules may restrict flash photography, movement, positioning, equipment, access, or other aspects of the photography service.

The Clients are responsible for checking relevant venue requirements and informing the Photographer of known restrictions before the shoot.

Professional Boundaries

Refusal to Shoot

The Photographer reserves the right to refuse or discontinue any photography activity that he reasonably considers unsafe, inappropriate, unlawful, excessively risky, or likely to cause physical or psychological harm to himself, the Clients, subjects, guests, or his equipment.

The Photographer may also decline particular photographs or requests that fall outside the agreed service or conflict with his professional boundaries.

Post-production & Photo Editing

Photograph Filtering

The Photographer may take a relatively large number of photographs during a session in good faith to increase the likelihood of obtaining strong images, particularly where subjects are moving, expressions change quickly, or circumstances are unpredictable. As a result, the original set may contain photographs that are unsuitable for final delivery.

After the shoot, the Photographer will review and filter the photographs to determine which images are reasonably suitable for the Clients' selection or final delivery. This process may remove photographs that are technically poor, unflattering, poorly timed, repetitive, or otherwise unsuitable.

Because photography and post-production involve professional judgement, the Photographer may retain certain photographs that could potentially be improved during editing while excluding others that are unlikely to produce a satisfactory final image.

Client Photo Selection

Where the selected package allows the Clients to choose their final photographs, the Photographer will first undertake a preliminary filtering process before presenting the selection images to the Clients.

Selection images may be presented in a low-resolution PDF or other suitable review format. The Clients will communicate their selections using the relevant photo numbers or other instructions provided by the Photographer.

Unedited Selection Images

Selection images are provided for review purposes only and do not represent the Photographer's final edited work.

The Clients must not publish, distribute, reproduce, edit, manipulate, upload, use, or otherwise share unedited selection images with other persons unless the Photographer has given prior written permission.

Basic Editing

Unless otherwise stated in the selected package, final photographs receive the level of basic editing included in the service. Basic editing generally includes adjustments to exposure, colour tone, and cropping where appropriate, according to the Photographer's professional judgement, style, and taste.

Basic editing is intended to present the photographs in the Photographer's standard finished style. It does not include extensive retouching, object removal, background replacement, reconstruction, body reshaping, or other substantial manipulation unless specifically stated.

Clients who wish to understand the Photographer's approach to post-production may refer to the post-production and editing page.

Retouching & Advanced Editing

Additional retouching or advanced editing may be available at an additional fee, depending on the requested work.

Advanced editing may include more extensive skin retouching, removal of distracting objects, detailed clean-up, or other work beyond the basic editing included in the selected package.

For particularly complex requests, the Photographer may describe the work as extreme editing. This may include substantial background replacement, reconstruction, removal of significant objects, major compositing, or other labour-intensive manipulation. Such work is assessed individually and may involve a significantly higher fee.

The availability of editing does not guarantee that every photograph can be successfully altered. Some photographs may be unsuitable for extensive manipulation because of technical, compositional, lighting, perspective, resolution, or other limitations.

Shooting & Editing Style

Every photographer has an individual approach to shooting and editing, including composition, colour tone, contrast, exposure, retouching, and overall presentation.

By engaging the Photographer, the Clients acknowledge and accept his established photography and editing style. The Clients should not expect the final photographs to imitate another photographer's work or editing style unless such an arrangement has been expressly agreed before booking.

Re-editing

The Clients may raise genuine technical concerns or errors with the Photographer. However, requests for changes based solely on personal preference or a desire to make the photographs resemble another photographer's style may be treated as additional editing work and may incur additional fees.

Quantity of Photographs

Where a selected package specifies a number of final photographs, the Photographer will aim to provide the stated number of suitable photographs.

If there are fewer suitable photographs than the stated quantity, the Clients will select from the photographs reasonably available. The Photographer does not create unsuitable images merely to reach a numerical target.

If there are more suitable photographs than the number included in the package, the Clients may have the option to purchase additional photographs at the applicable rates.

The Photographer does not guarantee that every photograph taken during the session will be suitable for final delivery.

Delivery of Photographs

Raw & Unedited Files

Raw, unedited, or "original" photographs, including camera RAW files, are not included as deliverables unless expressly agreed in writing.

File Format

Final photographs will generally be delivered as JPG files. Physical prints, albums, CDs, DVDs, thumb drives, or other physical media are not provided unless specifically included in the selected package or separately arranged.

Image Resolution

The default final image resolution is a maximum of 2048 pixels on the longest side at 300 DPI unless otherwise stated in the selected package or agreed before confirmation of the booking.

Clients requiring higher-resolution files, larger dimensions, specialised formats, or files intended for particular commercial or print applications should discuss these requirements before booking so that the Photographer can determine whether the requested specifications are reasonably deliverable.

Delivery Timeframe

Photography turnaround times vary according to the workload, number of photographs, complexity of the project, editing requirements, and other circumstances affecting the Photographer's schedule.

The latest general turnaround information is provided on the Rates page. Where a specific turnaround time has been discussed and agreed for an individual booking, the booking-specific arrangement will apply.

As a solo photographer who personally manages photography, selection, editing, administration, and delivery, the Photographer does not guarantee an exact delivery date unless a specific expedited or otherwise guaranteed arrangement has been expressly agreed.

Express & Expedited Delivery

The Photographer may offer express or expedited post-production where his schedule permits. Such requests must generally be made before the booking is confirmed so that the Photographer can determine whether the requested timeframe is practical.

Express or expedited delivery may incur additional fees depending on the duration of the shoot, number of photographs, requested timeframe, and post-production workload.

Delivery Method

Final photographs will generally be delivered through a private online download link.

Email delivery may be available at an additional charge but may not be practical where file sizes exceed normal email attachment limits. The Clients are responsible for ensuring that they have a suitable internet connection and sufficient storage to download the photographs.

Physical media such as CDs, DVDs, or thumb drives are not provided unless specifically arranged.

Online File Retention

The online delivery folder is provided as a temporary method of transferring the finished photographs and is not intended to function as a permanent backup service.

The online delivery folder and files may be deleted after the Clients have acknowledged receipt of the photographs, or after the stated download period has expired, whichever occurs first.

Redelivery of Photographs

The Clients are responsible for downloading and safely storing their delivered photographs.

The Photographer may retain working copies or backups for a period after delivery, but does not guarantee permanent archival storage of completed photographs. If the Clients require photographs to be re-uploaded after the original delivery period, an administration fee may apply and redelivery remains subject to file availability.

Photograph Storage, Loss & Damage

Loss or Damage to Photographs

The Photographer takes reasonable precautions to protect photographs throughout the photography and post-production process. After a shoot, photographs are normally transferred to the Photographer's computer and backed up to an external storage device as soon as reasonably practicable.

However, photographs may occasionally be lost, corrupted, damaged, or become unrecoverable before or during the transfer or backup process due to circumstances such as memory-card failure, equipment failure, accidental loss, theft, data corruption, storage failure, or other circumstances beyond the Photographer's reasonable control.

No storage or backup system can guarantee that photographs will never be lost or damaged. In particular, there may be circumstances where photographs are lost before a usable copy can be transferred from the camera's memory card.

If photographs are lost or become permanently unrecoverable before final delivery despite the Photographer having taken reasonable precautions, the Photographer will discuss the circumstances with the Clients and provide an appropriate remedy having regard to the circumstances, the extent of the loss, and the services affected, subject to applicable law.

Copyright & Usage Rights

Copyright Ownership

Unless otherwise agreed in writing, copyright in photographs created by the Photographer remains with the Photographer in accordance with applicable Singapore law.

Payment for photography services does not by itself transfer copyright ownership to the Clients. The Clients receive the usage rights expressly granted under this agreement, the selected package, quotation, or other written booking arrangement.

Personal Use

Unless otherwise agreed in writing, the Clients may make copies and use the delivered photographs for their own personal purposes and for sharing with friends and relatives.

Sale, commercial exploitation, licensing, publication for commercial purposes, or other uses outside the agreed usage rights require prior written permission and may require a separate licensing agreement.

Clients' Editing of Photographs

Clients must not materially edit, manipulate, add filters to, crop, distort, or otherwise alter the delivered photographs without prior written permission from the Photographer, except where such modification is expressly permitted by the applicable usage arrangement.

Commercial Usage

Commercial use of photographs is not automatically included in a personal photography booking. Commercial usage, advertising, publication, branding, resale, licensing, or other business use may require separate written permission and licensing terms.

Portfolio, Privacy & Published Content

Portfolio & Promotional Use

Unless the Clients have selected the applicable Privacy Guarantee (Privacy Buyout) or otherwise agreed in writing, selected photographs may be used by the Photographer for portfolio, website, social media, marketing, educational material, publications, competitions, or other promotional purposes.

The Photographer will exercise professional judgement when selecting photographs for publication and may consider the nature of the photography session, the suitability of the images, and the context in which they are presented.

Privacy Guarantee (Buyout)

Clients who require their photographs to remain private and unpublished may purchase the Privacy Guarantee (Privacy Buyout) before the photography session, subject to the applicable fee and terms.

The Privacy Guarantee prevents the covered photographs from being published or used by Skai Chan Photography for portfolio, marketing, educational, competition, social media, or other promotional purposes covered by the agreement.

The Privacy Guarantee does not transfer copyright ownership. Copyright and other usage rights remain governed by the applicable Service Agreement and booking arrangements.

Published Content & Write-ups

When photographs are published, the Photographer may accompany them with captions, descriptions, educational material, behind-the-scenes information, observations, stories, or other written content relating to the photography session.

Such written material may constitute the Photographer's own creative and editorial work. Unless otherwise agreed in writing, the Clients do not direct, control, approve, or edit the Photographer's write-ups, captions, or other accompanying creative content.

The Photographer will nevertheless remain subject to applicable privacy, contractual, and legal restrictions when publishing such material.

Names & Anonymity

Clients who do not wish their name, profession, identity, or other personal details to be mentioned in connection with published photographs should communicate this requirement before the photography session.

Where a specific anonymity requirement is agreed, the Photographer will take reasonable steps to comply with it. Requests made after publication may require additional administrative work and may incur an applicable amendment or removal fee.

Removal of Published Content

If the Clients later request that photographs or related published content be removed after publication, the Photographer will consider the request and may charge applicable fees for the work required.

This may include reviewing and removing webpages, social media posts, captions, write-ups, metadata, internal links, portfolio references, and other content affected by the removal.

Photography Consent & Model Release

Unless a Privacy Guarantee or other written restriction applies, the Clients consent to the Photographer using selected photographs of the Clients for the portfolio, editorial, competition, advertising, educational, promotional, and other purposes permitted under the applicable agreement and law.

This consent does not remove any rights or protections that cannot lawfully be waived or excluded. Where a specific privacy arrangement has been purchased or agreed, that arrangement will apply to the covered photographs.

Liability & Professional Responsibility

Recommendations

The Clients may ask the Photographer for recommendations regarding locations, vendors, makeup artists, hairstylists, venues, schedules, or other aspects of planning. The Photographer may provide recommendations based on personal experience, research, or professional judgement.

Unless otherwise expressly agreed, such recommendations are provided in good faith and do not guarantee availability, suitability, quality, pricing, performance, or the outcome of services provided by third parties.

Illness or Injury

If the Photographer becomes seriously ill or injured and is unable to provide the agreed photography service, he will make reasonable efforts to find a suitable replacement photographer where practical.

If a suitable replacement cannot be found and the agreed photography service cannot be provided, the booking fee received for the affected service will be refunded in full, subject to applicable law.

Equipment Failure

The Photographer takes reasonable precautions to maintain and prepare his equipment. However, photography equipment may occasionally malfunction or fail despite reasonable care.

Where equipment failure occurs, the Photographer will make reasonable efforts to continue the photography service using available equipment, alternative lighting methods, or other practical solutions.

Equipment Safety

The Photographer may refuse to place equipment in conditions where doing so would create an unreasonable risk of damage, loss, electrical danger, water damage, physical injury, or other safety concerns.

Limitations & Applicable Law

The Photographer will take reasonable care in providing the agreed photography service. Nothing in this agreement is intended to exclude or restrict any liability, right, or remedy that cannot lawfully be excluded or restricted under applicable law.

Where circumstances beyond the Photographer's reasonable control affect the photography service, any remedy will be considered having regard to the circumstances, the extent of the affected service, and applicable law.

Privacy Policy

Please refer to the Privacy Policy for detailed information about the collection, use, storage, retention, confidentiality, copyright-related privacy considerations, portfolio use, and Privacy Guarantee arrangements relating to personal information and photographs.

The Clients are encouraged to read the Privacy Policy before confirming a booking, particularly if confidentiality or restrictions on publication are important to them.

Client Acknowledgement

By confirming a photography booking, the Clients acknowledge that they have had a reasonable opportunity to read and understand the applicable terms, ask questions, disclose relevant requirements, and discuss any special arrangements with the Photographer before the booking is confirmed.

The Clients acknowledge that photography involves creative judgement, technical limitations, changing environmental conditions, cooperation from subjects and guests, and other circumstances that may affect the final photographs.

Please make sure you have understood the contents of this agreement and agree to the applicable terms before confirming your photography booking.

As much as some photographers admire my photography and writing, some have previously reproduced substantial portions of my unique Service Agreement without permission, sometimes replacing my name with their own. If you happen to encounter a photographer who appears to have copied this agreement or other original content from Skai Chan Photography, please let me know.
